Privacy Policy



This document regulates the treatment of the information YOU provide to
TEAMCULTURE.

Definitions



Anonymization - Use of reasonable and available technical means at the time of processing, through which a data loses the possibility of an association, direct or indirect, to an individual;

Application or Website - Technological tool through which you relate to and send information to TEAMCULTURE;

Client - Legal entity that hires TEAMCULTURE to provide organizational climate survey services;

Controller - TEAMCULTURE, which is responsible for decisions regarding the processing of personal data;

Consent - Free, informed, and unequivocal manifestation by which you agree to the processing of your data for this Privacy Policy;

Personal data - Information relating to you or another user of the TEAMCULTURE app or website;

Sensitive Personal Data - Personal data about racial or ethnic origin, religious belief, political opinion, membership of a trade union or religious, philosophical or political organization, data concerning health or sex life, genetic or biometric data when linked to a natural person;

Anonymized Data - Data relating to the holder that cannot be identified, considering the use of reasonable and available technical means at the time of its treatment;

Deletion - Deletion of data or data set stored in a database, regardless of the procedure used;

Foreman - Natural person, appointed by TEAMCULTURE, who acts as a communication channel between TEAMCULTURE and YOU and who has the duties provided for in item 20 and below;

Operator - Natural or legal person, public or private law, who performs the processing of personal data on behalf of the controller;

Processing: Any operation carried out with personal data, such as those relating to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation, or control of information, modification, communication, transfer, dissemination, or extraction;

TEAMCULTURE - Company incorporated under Brazilian laws whose corporate name is TEAMCULTURE DESENVOLVIMENTO DE SOFTWARES LTDA of CNPJ 31.673.943 / 0001-09; and

YOU - Holder of the personal data processed by TEAMCULTURE and user of the application and website of TEAMCULTURE and who has a relationship of provision of services or employment with the Client.

By using the TEAMCULTURE services you explicitly agree to this Privacy Policy and consent to the collection, storage, and use of your personal information as provided herein in this Privacy Policy.

Your information collected by TEAMCULTURE will be: i) your personal data, that is, your full name, date of birth, number of documents that identify you (RG, CPF, CNH, Work Card, etc.), filiation, name of your closest relatives (spouse and children), email addresses, cell phone numbers, physical address, among others; and ii) answers provided to surveys and forms sent to YOU by TEAMCULTURE. Other information can be collected and is provided throughout this instrument, such as browsing history, for example.

The personal data and responses provided for in items i) and ii) of Clause 2 above, constitute a necessary condition for TEAMCULTURE services to be provided to its customers.

There are 04 (four) ways to collect your data: (i) by your responses to forms and surveys sent by TEAMCULTURE to YOU from time to time according to the rules of the Terms and Conditions of Use to which YOU have agreed; (ii) utilizing the registration made by YOU on the website and/or application; (iii) by storing your usage history of the website and application; and (iv) through the use of cookies or other technology that allows storing information about your browsing on the website or application.

Your information is collected, stored, handled, processed, and used by TEAMCULTURE for the following purposes: (i) to obtain information that allows clients to evaluate their organizational climate; (ii) develop, maintain, and improve the features and functionalities of the website and application; (iii) analyze the performance of the website and the application, measure the audience of the website and the application, check your browsing habits on the website and the application, the way you arrived at the page of the website or the application, evaluate statistics related to the number of accesses and use of the website and the application, its features and functionalities; (iv) analyze the security of the website and the application; (v) improve your browsing experience on the website and in the application; (vi) enable the provision of more personalized services personalized to your needs, such as profile pages, updates, relevant content, and announcements; (vii) allow communication between YOU and TEAMCULTURE, including by sending and receiving emails or messages using communication platforms; (viii) identify the profiles, habits and needs for eventual offers of services and strategies from TEAMCULTURE or its partners (being the offers always sent through TEAMCULTURE).

TEAMCULTURE preserves your privacy and does not share your data and information with third parties, except as provided in the item below, with your express consent, by law, or under court order.

SYour responses to forms and surveys sent to you by TEAMCULTURE will be gathered in such a way as to preserve your identity, which will not be revealed under any circumstances unless you remove anonymity during your responses. The data obtained with your answers will be anonymized and presented to the Client to allow the analysis of the Client's organizational climate. The information may be sent detailing the responses provided by a particular department of the Client. However, such detail may only occur per department if the number of people who answer the surveys and forms in such department is more than 3 people and the feedback will only be presented if there are at least 5 people, thus ensuring the anonymization of the data.


Your answers to the forms and surveys sent to you will be stored by TEAMCULTURE and can be used, always in an anonymized way, in indicators to be developed by TEAMCULTURE. In this case, for example, it is possible to use some of your answers to compare the answers provided by employees of a particular Client with the answers of employees of other companies in the same market segment. In no situation, however, will there be the possibility of identifying the people who provided the answers.

Provided that the data is anonymized, you are aware and authorize that your browsing records on the website and the application are provided by TEAMCULTURE to its respective partners or contracted parties to provide any service relating to the website or the application for the purposes set out in item 4 above.

Cookies are small files that may or may not be added to the equipment used to access the website or application and that allows you to store and recognize data from your browsing. In your navigation, you can agree or not to the use of cookies, with the possibility of disabling cookies through your browser. However, by deciding to ban cookies, you are aware and acknowledge that the website or app may not perform all of its functionality.

TEAMCULTURE may collect, store, handle, process and use the following information regarding your browsing of the website or the application: (i) Physical location; (ii) Operating system used by YOU; (iii) Browser and its respective versions; (iv) Screen resolution; (v) Java (programming language); (vi) Flash player installed; (vii) IP address; (viii) ID code (IMEI) of the mobile device through which YOU accessed the website or application(ix) Information regarding the date and time of use of the website or application by a particular User from a particular IP address; ( x ) Information concerning the amounts of clicks and attempts to use the website and/or application, as well as the pages accessed by YOU.

The website or application may contain links to a third-party website(s). You acknowledge and agree that the existence of such links does not constitute endorsement or sponsorship of any third-party website(s) and you acknowledge that you are subject to the Terms of Use and Privacy Policies of the respective website(s).

You may not take the following actions because of or through your use of the website or application: (i) practice of any illicit acts and/or violation of the legislation in force, including the provisions of Law 9.613/98 and Law 12.846/13 in the Brazilian Legislation; (ii) acts contrary to morals and good customs; (iii) uploading, sending or transmitting any content that is erotic, pornographic, obscene, defamatory or slanderous or that makes apology for crime, drug use, consumption of alcoholic beverages or tobacco products, physical or moral violence; (iv) uploading, sending and/or transmitting any content that promotes or incites prejudice (including of origin, race, sex, color, sexual orientation and age) or any form of discrimination, as well as hate or illegal activities; (v) threat, coercion, physical or moral embarrassment to other Users; (vi) infringement of third-party rights; (vii) violation of others' rights of secrecy and privacy; (viii) acts which cause or promote the contamination or damage to any TEAMCULTURE or third-party equipment, including by means of viruses, trojans, malware, worm, bot, backdoor, spyware, rootkit, or any other devices that may be created; (ix) perform any acts that directly or indirectly, in whole or in part, may cause injury to TEAMCULTURE, any User and/or any third-party; ( x ) use any corporate name, trademark, domain name, slogan or advertising expression or any distinctive sign or intellectual property asset owned by TEAMCULTURE.

Your express consent to the processing of your information under this Privacy Policy may be revoked. In this case, YOU must send an explicit statement to the communication channel provided by TEAMCULTURE so that your information is no longer treated by TEAMCULTURE per Brazilian legislation and that such information is deleted.

In the event of termination of data processing, either by YOU revoking your consent or for another reason, your data will be deleted by TEAMCULTURE.

There will be no processing of Sensitive Personal Data.

You acknowledge, under Brazilian national law, that anonymized data is not considered personal data and therefore is not subject to the restrictions on the processing of information set forth herein unless anonymization can be reversed by your means or using reasonable efforts.

As long as there is a business relationship between TEAMCULTURE and its Client, the data processing provided for in this policy will remain in force, without prejudice to your right to revoke the data processing.

Data processing will be terminated when: (i) YOU request the revocation of the processing of your data; (ii) within 01 (one) year after the termination of the contractual relationship between TEAMCULTURE and its Client, a company with which YOU have an employment or service relationship. After the end of the data processing, such data will be permanently deleted from the physical and digital files of TEAMCULTURE, except for data that has already been anonymized and, therefore, that has ceased to be personal data.

TEAMCULTURE will define the name of a person who will be in charge of the processing of personal data. Their identity and contact form will be available on the website. Their assignment will be to receive your possible complaints, provide clarifications and take the measures that they deem applicable.

This Privacy Policy may be changed by TEAMCULTURE and will be informed to YOU using the available communication channels. After the change of the Privacy Policy, YOU will be asked to re-express your consent to the new privacy policy.
